High Court Throws Out Injunction Against PNC Congress

An Accra High Court has thrown out a motion seeking to injunct the leadership of the Peoples National Congress (PNC) from organizing a congress to elect a flagbearer for the 2012 elections.

The Court also awarded costs of GHS2,000 against the applicants.

Five persons, Ibrahim Karim, Haruna Abass, Abubakari Sadick Wiyor, Benard Bama-Ame and Michael Anafo were also seeking an order to restrain, Dr. Edward Mahama, Alhaji Ahmed Ramadan and Benard Momah from holding themselves as Leader, Chairman and General Secretary respectively of the party.

But the court presided over by Justice Emmanuel Dzapkasu said their case had no merit.

A former General Secretary of the PNC, Bernard Mornah who spoke to Joy News shortly after the ruling, said the party will hold an emergency National Executive meeting on Wednesday to fix a new date for the congress.

He said the party must take a decision as to whether it will continue to uphold the membership of those whose turbulent character vitiated the forward movement of the PNC.

Bernard Mornah debunked assertions that the internal wrangling has weakened the structures of the PNC and said the party will be better off without those whose objective it is to undermine its growth.

Counsel for the applicants, Dr. Somtim Tobiga, told Joy News the applicants never at any point opposed the PNC holding congress to elect a flagbearer.

What the applicants were seeking, he said, is a declaration that Dr. Mahama, Alhaji Ramadan and Mr Momah cannot hold themselves as Leader, Chairman and General Secretary respectively.

He said the court had stayed hearing on the aspect of the motion challenging the capacities of the three.

Dr Tobiga said a contempt charge had been filed against Mr Bernard Mornah whom he said contemptuously disregarded the court’s ruling and still paraded himself as a General Secretary of the PNC.

He said Mr Mornah had been served with the contempt processes.
