CJ Acts On Achimota School Land Dispute
The Judicial Service has given the assurance that measures adequate measures have been instituted to ensure speedy disposal of a suit over the ownership of unused portions of Achimota School land in Accra.
A statement signed by the Service’s Director of Communications, Mrs. Grace Tagoe, said the Chief Justice, Mrs. Justice Georgina Wood, has in that regard directed an Appeal Court Judge to sit as an additional High Court Judge “to ensure an expeditious disposal of the case.”
The Achimota School, one of the prominent schools in Ghana, currently faces closure by the Accra Metropolitan Assembly because of its broken down sewerage system, a situation caused by construction activities of encroachers on the school land which has blocked the flow of sewerage from the school.
The school has not been able to effectively deal with the problem of the encroachment due to a pending legal dispute between the school and some others over the ownership of unused parts of the Achimota school land.
The statement noted that the Judicial Service has noted public concern and comments over the imminent closure of the school, indicating that in September 2007, a total of eight suits were filed at the courts at the instance of Achimota School against various developers encroaching on the school’s land.
“As of November 2008, judgments have been delivered in seven and these were in favour of the school,” it said, adding that there have not been any appeals against the judgments.
It said only one case pending was filed on December 7, 2009 for which an injunction was granted on January 25, 2010 to restraining both parties from further constructional or demolition was pending.
The Service assured the public that “the matter would not be allowed to unduly delay,” and called for cooperation from both parties.
